1.     Acceptance Of Premier Access Website Terms and Conditions

Your access to and use of Premier Access website is subject exclusively to these Terms and Conditions. You will not use the website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the website.

2.     Your E-mail

2.1    Users may be required to register or login and provide an email address and limited information about themselves.  Premier Access does not automatically update or change personal information provided by users and users must therefore promptly update their registration information to ensure it remains complete, accurate, and current.  Premier Access reserves the right to suspend or terminate a user’s account if Premier Access determines or has a reasonable basis to believe that the user’s registration information is incomplete, inaccurate, or no longer current.

2.2    Users accept responsibility for any use of this Web site under their usernames, email addresses and/or passwords. Users will safeguard all passwords and agree not to disclose passwords to any third party. Users are advised that use of an employer email account or use of a personal email account on an employer computer may be subject to monitoring by the employer in accordance with applicable law and the employer’s Internet and email policies.

2.3    Users assume sole responsibility for any activities or actions under their passwords, whether or not they have authorized such activities or actions. Users will immediately notify Premier Access of any unauthorized account access.

3.     Posted Reviews

3.1    The Premier Access website may include Reviews which allow members to post comments on their experience at network dentist offices.

3.2    By entering the Premier Access site, you are acknowledging that Premier Access is not responsible for the content placed on the site by any person entering the site whether the information on the site is provided by Premier Access or a person associated with or affiliated with Premier Access or by any third person entering the site for any purpose. You further acknowledge that you will not seek to hold Premier Access liable for any information or material which you find objectionable or offensive, generally or specifically involving yourself. You further acknowledge and agree that it is possible that persons entering or using the site may express opinions or provide information which you find either objectionable, untrue, inaccurate, defamatory, or libelous. You acknowledge that Premier Access has no control over for such information or postings and that accordingly, you will not seek to hold Premier Access liable for such content, or such damages as you may suffer as a result of such statements or information.

3.3    You acknowledge that Premier Access will monitor the content of reviews and therefore may or may not be posted or delivered to the Review areas.  In recognition thereof, you shall not seek to hold Premier Access responsible or liable for any content you may find offensive, objectionable, untruthful or libelous. You further acknowledge and agree by entering and/or using the website, that Premier Access is not responsible in any manner for any opinion expressed on the site and the publication of information or content on the site does not in any manner represent any opinion, endorsement or statement by Premier Access. You further acknowledge that Premier Access does not have the ability to determine persons or entities making use of the site. Premier Access has limited control and does not have any obligation to monitor, the messages delivered to the Review area. It is a condition of your usage of the Premier Access website, including, without limitation, Review areas, and your use of the correspondence that you do not:

1. Post or transmit material to this Site, including, without limitation in the Review area, that is libelous, defamatory, obscene, fraudulent, harmful, threatening, abusive, hateful, vulgar, pornographic, profane or indecent, or that violates the intellectual property rights of others or on the privacy or publicity rights of others.
2. Use a Review area for any purpose in violation of local, state, national, or international laws.
3. Engage in any conduct that restricts or inhibits any other person from using or accessing the Review area or the Site, or which, by the judgment of Premier Access, exposes Premier Access or any of its suppliers, customers, or  partners to any liability or detriment of any type.
4. Use this Site or Review areas to post, email, upload any advertisements, spam, pyramid schemes, chain letters, or other promotional materials.
5. Use this Site or Review areas to post or transmit any file which contains viruses, worms, Trojan horses or any other contaminating or destructive features.
6. Post or transmit any message anonymously, or under a false name, impersonate any person or entity, or otherwise misrepresent yourself, or your affiliation with a person or entity.

4.     Credit Card Details

Premier Access may ask for credit card details  through this website only if you are purchasing dental benefits online.

5.     Security

Premier Access offers the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology to be only accessed by authorized individuals who are required to keep the information confidential.

After a transaction, your private information (credit cards, social security numbers, financials, etc.) will not be stored on our servers. If a user is a member of any of our products, their social security number may be stored, however, this information will not be collected as part of an online transaction.

6.     Advice

The contents of the Premier Access website do not constitute advice and should not be relied upon in making or refraining from making any decision.

7.     Change of Use

7.1    Premier Access reserves the right to change or remove (temporarily or permanently) the website or any part of it without notice and you confirm that Premier Access shall not be liable to you for any such change or removal.

7.2    Premier Access reserves the right to change these Terms and Conditions at any time at the sole discretion of Premier Access, and your continued use of the website following any changes shall be deemed to be your acceptance of such change.

The Premier Access website may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

9.1    All copyright, trademarks and all other intellectual property rights in the website and its content (including without limitation the website design, text, graphics and all software and source codes connected with the website) are owned by or licensed to Premier Access or otherwise used by Premier Access as permitted by law.

9.2    In accessing the website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the website for personal, non-commercial home use only.

10.3   Premier Access makes no warranty that the functionality of the website will be uninterrupted or error free, that defects will be corrected or that the website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

10.4   Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Premier Access for death or personal injury as a result of the negligence of www.premierlife.com or that of its employees or agents.

10.5    Dental services offered herein are underwritten and administered by either, Premier Access Insurance Co, a life/disability insurer licensed under the insurance laws of California or Access Dental Plan, Inc., a specialized health care service plan licensed in the State of California under the Knox-Keene Health Care Service Plan Act of 1975.

11.  Indemnity

You agree to indemnify and hold Premier Access and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Premier Access arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this website.

12.  Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

13.  Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the law of the United States of America and you hereby submit to the exclusive jurisdiction of U.S. courts.

14.  Continuing Education Credit – Courses

14.1    You must be a contracted provider with Premier Access in order to gain access to the course material and receive course credit.  CE Credit courses are available to all providers in Premier Access contracted offices.  Each provider must register and accept the terms and conditions individually.

14.2    There is no time limit requirement nor is there a restriction on the number of attempts to take a course or the quiz at the end of each course.

14.3    You must only use the service and website for your own lawful purposes, in accordance with these terms and any notice sent by us or condition posted on the website.

14.4    We let you use the service and website to provide online courses to others including your associates, employees or otherwise trainees.  You must make sure that all trainees that access the courses are given, comply with, and accept terms between you and the trainees that incorporate these terms that apply to you.

14.5    You acknowledge that you are solely responsible for your  or your trainee’s actions while using the website and services and agree to indemnify and defend us from any claims, demands or lawsuits of any kind arising from your or your trainee’s breach any of these terms.

14.6    There is no cost for taking the online courses as these are being provided to contracted providers of Premier Access as a benefit for participation.

14.7    You hereby acknowledge that it is your responsibility to ensure these courses meet the Continuing Education requirements for the State in which you are licensed.

14.8    You agree not to do or omit to do anything which gives rise to any liability on your part or our part under any legislation or omit to do anything which would avoid that liability.  This includes not making any representation or giving any guarantee, warranty or other undertaking to anyone including your trainees in relation to the services unless that representation, guarantee, warranty or undertaking is supplied by us.

14.9    You are not allowed, and cannot allow others, to  copy, alter, distribute, display license, modify or reproduce, reverse assemble, reverse compile (whether digitally, electronically, by linking, or in hard copy or by any means whatsoever) or use any of or intellectual property without getting our permission first in writing, unless in order to use our website the way you are supposed to use it you need to copy, reproduce or use the intellectual property.

14.10    Premier Access reserves the right to change or remove (temporarily or permanently) the website or any part of it without notice and you confirm that Premier Access shall not be liable to you for any such change or removal.

14.11    Premier Access reserves the right to change these Terms and Conditions at any time at the sole discretion of Premier Access, and your continued use of the website following any changes shall be deemed to be your acceptance of such change.

14.12    Premier Access’ website Privacy Policy and website Terms and Conditions are applicable for users of the CE Credit module.
